TERMS & CONDITIONS

Please be aware that the customer’s use of the fabula website establishes their agreement to observe our terms and conditions. These conditions may be subject to change at any time and without notice. Customers must continue to check this page frequently prior to placing an order to ensure they are completely aware of our T&Cs.

General Information

www.fabulatoys.com is the only website of Fabula Educational (IOM) Limited, 4 Ballaquane Road, Peel, IM5 1PP, Isle of Man, United Kingdom. These conditions apply between each customer and Fabula Educational (IOM) Limited and does not affect the rights they may have under any relevant statutory law.

 

Shipping

All orders placed before 1PM will be dispatched the same day and delivered within 48 hours of dispatch. For all orders after 1PM, products will be dispatched the next day and delivery will be 48 hours after dispatch. Dispatch of products are controlled directly by the business and will be managed in a timely manner. All deliveries are managed by the Royal Mail and therefore we work with the 48 hour process in their Standard Operating Procedures. 48 hour deliveries are only valid for weekdays and do not apply to weekends or public holidays. 

 

Returns & refunds

Products can be refunded or exchanged within 14 days of delivery. Customers must return the product within an additional 14 days after formally informing us of the decision. fabula will refund the amount to the customer within 14 days of receiving the products back. 

 

Site Transactions

Customers must agree that their email address, as entered during placing the order, will be used as a means of communication, notification and billing between fabula and its customers. Under certain circumstances we hold the right to cancel or limit any order placed. In the event of such decisions, we will contact the customer either via telephone or by email as mentioned earlier. 

 

Product Reviews

In order to maintain the relevance and decorum on the website, we request for the following rules to be followed:

1. All reviews MUST be written by the individual associating their name with it. Users may neither have others write their reviews, nor use someone else’s name on their review
2. The right to post or delete a review lies solely in the hands of fabula and no explanation will be offered for decisions surrounding it
3. Any review posted on the website might be used for marketing purposes across our channels. fabula holds the right to these reviews and is not bound to inform the reviewer before using their quote elsewhere
4. fabula is open to both positive as well as negative reviews, however anything with inappropriate language or content will be deleted right away
5. Reviews must neither violate anyone’s copyright or trademark, nor contain libellous or otherwise unlawful, abusive or obscene material. The creator of the review will be held responsible for it

 

Use of the Site

All transactions on www.fabulatoys.com require signing in with a username and password. It is the responsibility of each user to store these details safely since all actions associated with these credentials will be considered to be theirs. If the customer is sharing a computer with someone else or are using a computer in a public place, they must remember to log off after their visit and close the browser.

Upon registering, customers will be asked to share some basic information about themselves. Customers MUST enter accurate, current and complete information including financial information around method of payment – either their debit/ credit card or PayPal details with a view to having enough funds to cover the cost of the order.

Customers MUST be over 18 years of age and agree that all toys bought on this website is for personal use only. 

 

Product Information

The fabula team has tried our best to take the most accurate photography of products. However we remain aware that there might be small differences in the final product that is delivered to customers. Also, some details of the photograph might vary depending on the device that the customer uses to view them. Fabula cannot guarantee 100% consistency across the colour, texture or details of our products as displayed on the website.

 

Product Availability

Owing to a 24-hour refresh cycle, there is a chance that stock availabilities are not 100% accurately displayed on the website. Under the circumstance that a certain ordered product is out of stock, the fabula team will be in touch with the customer over either email or phone.

 

Orders

When placing an order with fabula toys, customers must agree that any and all information shared on this website for registration is accurate and complete. All orders are subject to acceptance and product availability.
fabula reserves the right to suspend the use of the website at any time to perform essential maintenance, update information and to remove any inaccurate or unauthorised material.

 

Cancellation Right

Under the distance selling regulations of the United Kingdom, all customers have the legal right to cancel an order within a cancellation period of 14 days. Customers are not liable to share a reason for their cancellation. The 14 day period begins from the day the item/ last product of the order is delivered. Customers must write to play@fabulatoys.com to inform us of their decision to cancel their order within the period of 14 days along with the Order Number.

This website, as a whole, is protected by copyright, trademark, trade dress, intellectual property and other applicable laws. The content of this website, are intended for the customer’s sole, non-commercial use.

No right, title or interest in any downloadable content is transferred to any user as a result of downloading or copying of content from the website. Users must not reproduce, publish, transmit, distribute, modify, sell or exploit in any way any of the content or site.

 

Collection of customer information

At fabula toys, we consider data protection and privacy to be of utmost important. We collect personal information on our website when a customer:
(1) Creates an account on our site

(2) Places an order through our site

(3) Fills in forms on our site

(4) Subscribes to our email newsletters/ catalogues/ etc.

We will also collect certain information automatically when a customer visits our site, in particular, when:
(1) They access our site, we use “cookies” to make it easier for them to use our site and to give them the best experience. These cookies record data about the pages they browse and the activities they carried out during their visit. 

(2) We record details of the resources that customers access to visit our site (for example, URL addresses, traffic data etc.).

We also collect data when a customer contact us either by email or phone or on social media. Details include name, address, phone number, payment details, date of birth, etc.

Usage of customer information
Information we collect from customers may be shared between all departments within fabula toys and our third party suppliers and agencies for the following reasons:

(1) To fulfil the contract the customer entered into when they ordered goods from us - to create an account, deliver the order, collect the payment or provide a receipt

(2) To send relevant marketing information only on having received prior consent from the customer

(3) To respond to customer service queries

 

Sharing customer information

fabula shares customer information with our core service providers and third party platforms as required for our business to function; for example, fulfilling deliveries, fraud detection, credit risk reduction checks, IT systems support, and internal audits.

We also use services offered by Google, Facebook, Instagram and other similar social media platforms to better tailor our marketing communications and for targeted advertising. As part of this process, some personal information, such as customer email address, is provided to the relevant third party. However, for security purposes, this data is “hashed” prior to being shared which means we do not disclose customer emails but can still enable linking between their social media presence and our site.

We may share some personal data with the police or other companies and organisations assisting us in fraud prevention or investigation and credit risk reduction when permitted or required to by law, or when trying to protect against or prevent actual or potential fraud or unauthorised transactions, or investigating fraud that has already taken place.

 

Storing customer information

By submitting their personal information to us, customers agree to the transfer, storing and processing of their personal information to an extent necessary to fulfil their order. 

Any information relating to credit card details is handled by a PCI DSS compliant third party and encrypted using secure server technology. Once we receive customer information, we use strict procedures and security features to try to prevent unauthorised access.

fabula saves customer information for:

1. As long as the customer remains subscribed to our marketing communications. (Customers can choose to unsubscribe either by following the link on all marketing emails or by writing to play@fabulatoys.com)
2. For a period of 24 months after the inactivity of the customer

Please be advised that we will never ask for personal details or information via email. If a customer receives an email asking for their personal information, username or password, or payment information, please do not respond and contact our customer service team immediately on play@fabulatoys.com 

 

Discounts and Offers

Discounts and offers are not valid on sale items, multibuys or gift cards and cannot be used in conjunction with any other offer. We reserve the right to end any discounts or offers at any time including before the advertised end date without notice. 

If a product has been bought at a discount, it cannot be refunded for the full and original price of the item. The applied discount will be taken into consideration. 

 

Payment Information

At www.fabulatoys.com, customers can choose a payment option among PayPal, debit and credit cards as well as our special fabula gift card of various denominations. For details on the terms & conditions of our gift cards, please refer to the gift card section of our website.

As is common practice in the UK, all credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of a payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.

The chosen form of payment will be charged at one transaction for the full amount of the order at point of order confirmation. We will aim to deliver all products of the order in the same parcel. However should there be items on the order that are out of stock, we will aim to have them delivered within 28 working days. Should that not be possible for some reason, we will be in touch with the customer to keep them informed of the status either through their registered email address or phone number. Customers will be given the option to either wait for the product to come back in stock or to apply for a refund.

 

PayPal Payment Information

Owing to PayPal’s internal processes, all payments being made through the system will be debited directly at the time of order, before items can be shipped. In the unfortunate event that the items ordered are out of stock, the order will be cancelled and the customer will be refunded immediately.

 

Disclaimers

Customer are informed that their use of this site is at their sole risk. fabula toys expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose and any warranties that materials on the site are non-infringing, as well as warranties implied from a course of performance or course of dealing; that access to the site will be uninterrupted or error-free; that the site will be secure; that the site or the server that make the site available will be virus-free; or that information on the site will be complete, accurate or timely. If a customer downloads any materials from this site, they do so at their own discretion and risk. They will be solely responsible for any damage to their computer system or loss of data that results from the download of any such materials. No advice or information, whether oral or written, obtained by a customer from fabula toys or through or from the site shall create any warranty of any kind. fabula toys does not make any warranties or representations regarding the use of the materials on this site in terms of their completeness, correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise.

 

Limitation of liability

Customers acknowledge and agree that they assume full responsibility for their use of the site. They acknowledge and agree that any information they send or receive during their use of the site may not be secure and may be intercepted by unauthorised parties. They acknowledge and agree that their use of the site is at their own risk and that the site is made available to them at no charge. Recognising such, they acknowledge and agree that to the fullest extent permitted by applicable law, neither fabula toys nor its affiliates, suppliers or third party content providers will be liable for any direct, indirect, punitive, exemplary, incidental, special, consequential or other damages arising out of or in any way related to the site, or any other site they access through a link from this site or from any actions we take or fail to take as a result of communications they send to us, or the delay or inability to use the site, or for any information, products or services advertised in or obtained through the site, fabula toys’ removal or deletion of any materials submitted or posted on its site, or otherwise arising out of the use of the site, whether based on contract, tort, strict liability or otherwise, even if fabula toys, its affiliates or any of its suppliers has been advised of the possibility of damages. This disclaimer applies, without limitation, to any damages or injury arising from any failure of performance, error, omission, interruption, deletion, defects, delay in operation or transmission, computer viruses, file corruption, communication-line failure, network or system outage, loss of profits, or theft, destruction, unauthorised access to, alteration of, loss or use of any record or data, and any other tangible or intangible loss. Customers specifically acknowledge and agree that neither fabula toys nor its suppliers shall be liable for any defamatory, offensive or illegal conduct of any user of the site. The customer’s sole and exclusive remedy for any of the above claims or any dispute with fabula toys is to discontinue their use of the site.

 

Indemnification

The customer agrees to indemnify, defend and hold harmless fabula toys and its affiliates and their officers, directors, employees, contractors, agents, licensors, service providers, subcontractors and suppliers from and against any and all losses, liabilities, expenses, damages and costs, including reasonable lawyers' fees and court costs, arising or resulting from their use of the site and any violation of these Terms of Use. If they cause a technical disruption of the site or the systems transmitting the site to themselves or others, they agree to be responsible for any and all losses, liabilities, expenses, damages and costs, including reasonable lawyers' fees and court costs, arising or resulting from that disruption. fabula toys reserves the right, at its own expense, to assume exclusive defence and control of any matter otherwise subject to indemnification by the customer and, in such case, they agree to cooperate with fabula toys in the defence of such matter.

 

Entire Agreement and Admissibility

This agreement and any policies or operating rules posted on this site constitute the entire agreement and understanding between the customer and fabula toys with respect to the subject matter thereof and supersede all prior or contemporaneous communications and proposals, whether oral or written, between the parties with respect to such subject matter. A printed version of these Terms of Use shall be admissible in judicial or administrative proceedings based on or relating to use of the site to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

 

Termination

These terms are effective unless and until terminated by either the customer or fabula toys. fabula toys may terminate this agreement at any time without notice, and accordingly may deny the customer access to the Site, if in our sole judgment they fail to comply with any of the Terms. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination for all purposes.
